Many men and women have an accident and question if they can claim compensation for the injury or upset that they have endured. Tons of cases are very clear cut when it comes to personal injury as for an example road traffic accidents and accidents caused by other people. This is mainly because there is a clear place to point the blame.
But some personal injury compensation claims are not so clear cut or so it may seem to anyone who does not fully understand the system. All personal injury lawsuits differ in the way that they are all unique in terms of the way that they occur. But there is a commonplace component with all accidents and that factor is there is another person who caused the accident, the individual may perhaps you or it just might be the negligence of another person or company.
Take a glance at the lawsuits below, each are real claims but for official grounds the personal particulars have been excluded.
Lawsuit 1
Mr x was making use of an alloy step ladder to access a roof where he was carrying out work, when climbing the ladder the system that locks the ladder and prevents the unit form closing broke. The ladder closed while Mr X was still ascending the alloy ladder and he fell from almost 2 meters in height. Mr X broke his leg as a result of the fall and was unable to work for quite a while. The case was taken to court to fight for damages for the personal injury that Mr X had received. It was unearthed in the court hearing that Mr X had been making use of the ladder to access an extension roof whilst carrying an amount of house bricks. The joint weight of Mr X and the house bricks did in fact exceed the safe working weight threshold of the alloy ladder. The judge decided that the claim was one of abuse of the product and no compensation was awarded to Mr X
Case 2
Mrs Y was using an aluminum ladder to access an attic opening and when she was ascending the alloy ladder a similar thing occurred. The locking device that prevents the aluminum ladder from folding failed and the aluminum step ladder collapsed whilst Mrs Y was still on it. This case is nearly identical to the instance above but when scrutinized properly it was found that there was a production defect with the aluminum ladder. The company who produced and marketed the ladder was ordered to pay Mrs Y for her personal injury.
The point I am trying to make here is that there is always somebody accountable, but that person maybe you. It is stupid to try and claim for an incident that is your mistake as you will not stand a chance of winning the case. Most no win no fee law firms will not take on a lawsuit that is not straight forward or they know that there is no way of winning. If you think that you are entitled to compensation for any kind of reason then it is strongly suggested that you talk with a personal injury solicitor to see if you have a decent case.
